MONROE CITY PLANNING COMMISSION

March 21st, 2023

1.         Chairman Bart Lee conducting- Meeting called to order- Prayer- Roll call.

The regular meeting of the Monroe City Planning Commission was called to order by Chairman Bart Lee on March 21, 2023, at 7:00p.m. Opening prayer was offered by Commissioner Northrup.

2.         Approval of previous meeting minutes held February 21st, 2023.

Commissioner Northrup made a motion to accept the minutes with the stated corrections.  Seconded by Commissioner Dickinson.

3.         Citizens comments.

No citizens with comments were present.

4.         Conditional Use License “Mystic Manor Airbnb” located at 40 N 100 E. Submitted by Mikki Webb.  

 Mikki Webb and her husband would like to get licensed to run an Airbnb in Monroe. She has all the required paperwork for the license filled out but she made the comment on the inspection page that she put N/A on the space heater portion. She does not have any in the home. Commissioner Lee told her that if she was not going to store any or have any on the property then that is just fine. Mikki submitted a very detailed letter concerning the property including her house rules for the rental. She has plenty of parking for guests so that would not be an issue. Commissioner Lee asked if any of the commissioners had any questions or comments for Mikki? Commissioner Roberts felt everything looked in order. The Commissioners had no other questions or comments for Mikki.

Commissioner Roberts made the motion to recommend approval to the Monroe City Council for “Mystic Manor Airbnb” Seconded by Commissioner Northrup. All were in favor. Motion passes 5-0.

5.         Conditional Use license “Jones Road Rental” located at 1171 S Jones Road. Submitted by Mikki Webb.

Mikki Webb and her husband are applying for a second license for an additional Airbnb. Commissioner Lee said that this property looks as good as the first one. He asked the Commissioners if they have any questions for concerns on this property? No other questions or concerns were asked.

Commissioner Northrup made the motion to recommend approval to the Monroe City Council for “Jones Road Rental” Seconded by Commissioner Dickinson. All were in favor. Motion passes 5-0.

6.         Minor subdivision concept plan “TCB Wealth” located at approximately 330 S 300 W. Submitted by Javalan Redd.

Javalan informed the commissioners that they are going to be changing the name of the subdivision but nothing official has been set. Javalan and his work partner would like to divide up a couple of existing parcels to create the subdivision. The first lot he would like to divide would leave a current residential home on it, and from that lot create an additional lot large enough for a duplex.  The third lot he would like to divide it into another parcel for a residential home. Commissioner Lee asked about the presented property lines and measurements. Javalan informed the commissioners that what they are presenting has all the city requirements for each parcel. Commissioner Lee asked if any of the splits have been recorded yet and Javalan told them no. That is why he is here tonight, to make sure the commissioners are ok with what he would like to do. The commissioners reviewed frontage and Javalan has enough for each lot. Commissioner Lee asked about lot #9 that jogs through the property if Javalan owns it or not? Javalan gave them a little history of the property and stated that it doesn’t have enough frontage or enough square feet to build on. He would like to sell it to the neighbor if possible. It would help the neighbor out more then Javalan to own the parcel. Javalan asked if he didn’t know what was going to happen with that lot if that would hold up the decision tonight to move forward? Commissioner Lee and Commissioner Roberts, both told him that it shouldn’t. Commissioner Lee’s next question was about water. Javalan told them as far as irrigation goes there are currently two irrigation risers on the property. Commissioner Lee informed him that if he wants to install more irrigation risers on the new proposed lots, he will have to pay for those. He also noted that water meters for culinary water will also have to be purchased and installed. Commissioner Lee asked the commissioners if they had any other questions? Commissioner Lee told Javalan he can move forward with getting a survey done, there is no motion needed on what they discussed tonight.

7.         Public hearing to receive comments concerning a proposal for a zone change from AR-1 to RR-1 affecting property located north on 300 W from 40 S to 450 N and continues west to 600 W.

Commissioner Lee closed the regular planning commission meeting and opened the public hearing on 7:19 p.m. on March 21, 2023.

Commissioner Lee stated the planning commission would like to change the rural agricultural zone to the rural residential zone. A question was asked of why and what is the benefit of doing this? Commissioner Lee stated the why is the city has been updating their land use book and they have come across the rural agriculture zone which has the same rights and restrictions as the rural residential zone. The only change from the rural agriculture zone to the rural residential zone is no grazing is allowed. You can still have animal rights and the water rights are the same in both zones. Someone asked if they are just renaming it? Commissioner Lee said in a sense, yes. A citizen asked if they wanted to do a small business in that area would that still be allowed or does changing to the rural residential zone make that an absolute no? Commissioner Lee told her that there is no change to what would or wouldn’t be allowed in the rural residential zone from the rural agriculture zone for businesses. Maps were passed around showing what the agriculture zone was and what it is now, which has all been developed into residential neighborhoods. The question was asked about what animal rights would be changed from the agricultural to the residential and again, the answer was that there would be none. The rights are universal across the board. Commissioner Northrup said that the animal rights stay the same, those rights are not changing at all. Commissioner Lee restated that they are only trying to change the zone name. The benefit of living in Monroe is being able to have those animal rights. A question was asked about CCRs in a subdivision and the response was that Monroe City does not enforce those CCRs. If those CCRs do not allow certain animals, businesses or buildings that has nothing to do with the Monroe City. Commissioner Lee asked the citizens if any of them have a reason for the city to not move forward with the zone change? No other comments were stated.

Commissioner Lee closed the public hearing at 7:31 p.m. on March 21, 2023.

Commissioner Lee reopened the regular planning commission meeting at 7:31 p.m. on March 21, 2023.

8.         Review Short-Term Rental Policy.

Commissioner Lee asked if the commissioners had any questions about the final draft of the short-term rental policy? All commissioners agreed and felt confident with what was presented about moving forward with the policy. There is no motion needed.

9.         Other Business

No commissioners had any further business.

10.       Adjournment.

Commissioner Northrup made a motion to adjourn at 7:48 seconded by Commissioner Dickinson. All were in favor. Motion passes 5-0. Meeting adjourned.
